Who has access to EES data and for what period?

The data are the EES is available for:

  • border guards, visa and migration services – to verify the identity of travellers,
  • law enforcement authorities and Europol – in strictly defined cases, for the purpose of protecting public order,
  • authorised carriers – only to check whether the short-stay visa still entitles you to entry.

In exceptional situations, data may be transferred to other countries or international organisations (e.g. UN, IOM, Red Cross) for return or public security purposes, in accordance with Regulation (EU) 2017/2226.

Data retention period

Travelers' data will be stored in the system only for the purposes for which they were collected and for a certain period of time indicated in the table below.

Entries for each entry, exit or refusal of entry

3 years starting from the date of creation of the entry, exit or refusal of entry alert

Personal files containing personal data

3 years and 1 day starting from the date of the last exit or from the date of refusal of entry (in case of no entry permit)

In the absence of an exit alert

5 years starting from the date of expiry of the period of permitted stay.

Alerts on the entry and exit of third-country nationals who:

  • are family members of Union citizens or third-country nationals who can travel throughout Europe under the same rules as EU citizens,
  • do not have a residence document, and
  • accompany a citizen of the Union, EEA or Switzerland who travels to or resides in a Member State other than that of which he or she is a national.

1 year starting from the date of creation of the trip entry.

In the absence of an exit allert concerning the departure and when the traveller:

  • is a family member of a Union citizen or a third-country national who can travel throughout Europe under the same rules as an EU citizen;
  • does not have a residence document, and
  • accompanies a citizen of the Union, EEA or Switzerland who travels to or resides in a Member State other than that of which he or she is a national.

Travellers' data will not be stored. The length of the permitted stay is not calculated.

After last of each period, personal data are automatically deleted from the system.
